How a microschool opens legally in Alaska: the exempt private school route

Alaska has no approval, licence or accreditation to obtain. A private or religious school operates under an exemption in statute: it is released from most education law, but not from law on physical health, fire safety, sanitation, immunization and physical examinations. It keeps monthly attendance records, runs at least 180 days, and reports its enrolment and calendar to the commissioner each year.

Read this before you spend anything: Alaska has no scholarship program of its own. Funding here would come from the new federal tax credit scholarship, which starts January 1, 2027. The IRS has not published final rules, so nobody can yet say how a microschool qualifies. This kit covers opening and running legally in Alaska. It does not promise scholarship funding.

The gate: Meeting the conditions of the private school exemption in AS 14.45: 180 days, monthly attendance records, an annual report to the commissioner, and families filing an annual notice of enrollment

What the rules actually say

“is exempt from other provisions of law and regulations relating to education except law and regulations relating to physical health, fire safety, sanitation, immunization, and physical examinations.”

— Alaska Statutes AS 14.45.100 to 14.45.200: exempt private and religious schools

“shall file an annual notice of enrollment in the school for the child with the local public school superintendent for the area in which the child resides on a form provided by the department.”

— Alaska Statutes AS 14.45.100 to 14.45.200: exempt private and religious schools

“shall maintain monthly attendance records for each student enrolled in the school, shall operate on a regular schedule, excluding reasonable holidays and vacations, during at least 180 days of the year, shall make an annual report to the commissioner of the number of students in each grade and the school calendar”

The sequence, in order

1. Confirm you need no state approval. Alaska does not approve or license private schools. You operate by meeting the exemption conditions in AS 14.45.
2. Form the entity and set up the building. Health, fire safety and sanitation law still applies to exempt schools, so settle these with your local authorities first.
3. Set a calendar of at least 180 days. This is the gate. Required by AS 14.45.110.
4. Keep monthly attendance records. For every enrolled student.
5. Have families file their annual notice of enrollment. This is the gate. Each family files it with the local public school superintendent on the department's form.
6. Collect immunization and physical examination records. Exempt schools remain subject to immunization and physical examination law.
7. Send the annual report to the commissioner. This is the gate. The number of students in each grade and your school calendar.

Where founders actually stall

Founders look for an approval that does not exist, or miss the parts that do apply: the family notices, the annual report, and health and safety law. The annual report deadline is widely quoted but we could not confirm it on an official page, so check it with the department.

What we have not verified

The deadline for the annual report to the commissioner. A date is widely repeated but we did not find it in statute or on an official page.

Whether Alaska requires background checks for private school staff. We found no requirement in AS 14.45, which is not proof that none exists.

We would rather say this than guess. Everything above that is stated as fact carries a link to the primary source, so you can check us.
