How a microschool opens legally in Colorado: no state gate at all

Colorado asks almost nothing of a private school at state level. There is no licence or registration, a state school code is optional, and the Department of Education has no jurisdiction over the internal affairs of independent schools. What matters is that children attend at least 172 days of basic academic education, that you answer attendance requests from your school district, and that you meet local health, building and fire rules.

Read this before you spend anything: Colorado has no scholarship program of its own. Funding here would come from the new federal tax credit scholarship, which starts January 1, 2027. The IRS has not published final rules, so nobody can yet say how a microschool qualifies. This kit covers opening and running legally in Colorado. It does not promise scholarship funding.

The gate: Nothing at state level. A child attends lawfully when enrolled at least 172 days in an independent school providing a basic academic education; health, building and fire rules are local

What the rules actually say

“is enrolled for a minimum of one hundred seventy-two days in an independent or parochial school which provides a basic academic education”

— Colorado Department of Education: Legal requirements for non-public schools

“Neither the State Board of Education nor any local board of education has jurisdiction over the internal affairs of any nonstate, independent, or parochial school in this state.”

— Colorado Department of Education: Legal requirements for non-public schools

“Colorado non-public schools are not required to obtain a CDE assigned school code.”

— Colorado Department of Education: Non-public schools

“This is for those private school educators who are not required to hold licensure, but where the governing board of the nonpublic school requires a fingerprint background check pursuant to 22-1-121, C.R.S.”

— Colorado Department of Education: Fingerprinting for private schools

The sequence, in order

1. Confirm you need no state approval. Colorado does not license or register private schools, and a state school code is optional.
2. Form the entity and set up the building. Health standards and local building, zoning and fire codes apply. These are local, not the Department of Education.
3. Plan at least 172 days of basic academic education. This is the gate. This is what makes attendance at your school lawful for compulsory-age children.
4. Keep attendance records you can certify. Your school district can ask, no more than once a month, for each child's name, age, residence and days attended.
5. Decide on fingerprint background checks. Colorado leaves this to your governing board. We recommend it; insurers and families will expect it.
6. Decide whether to request a school code. Optional. It lists you in the state directory; it is not permission to operate.

Where founders actually stall

Founders assume the state school code is a licence, or look for a regulator that does not exist. The real work is local: the building, fire and health sign-offs.

What we have not verified

Whether Colorado sets any teacher qualification for private school teachers. We found no requirement, which is not proof that none exists.

We would rather say this than guess. Everything above that is stated as fact carries a link to the primary source, so you can check us.
