The gate: No state approval. A nonpublic school is legal without accreditation or certification; it must meet Kentucky law on attendance, instructional time, subjects taught and records kept
What the rules actually say
“Although non-public schools are not required to be accredited or certified to be considered legal schools, their oversight is the responsibility of each local school district or a governing body such as a diocese.”
“KRS 156.160(3) provides that nonpublic schools may voluntarily comply with the curriculum, certification, and textbook standards established by the Kentucky Board of Education (KBE) and be certified upon application to the board.”
“KRS 158.070 establishes the "Student instructional year" as at least one thousand sixty-two (1,062) hours of instructional time for students delivered on not less than one hundred seventy (170) student attendance days.”
“Non-Public schools must adhere to Kentucky laws regarding school attendance, minimum instructional hours, subjects taught and records kept.”
The sequence, in order
Where founders actually stall
The Board of Education "certification" language reads like a licence, and many secondary sources treat it that way. It is voluntary. The work that remains is the calendar, the curriculum and the records.
What we have not verified
Kentucky health and safety rules (immunization, fire inspection) specific to non-public schools. The official pages we read frame these for public schools.
Whether Kentucky requires background checks for staff at uncertified private schools.
We would rather say this than guess. Everything above that is stated as fact carries a link to the primary source, so you can check us.
