In North Dakota, a microschool usually operates as a private school or a program serving homeschooling families. ND does not license/register private schools (§15.1-02-11) but the Superintendent must approve nonpublic elementary/secondary schools (§15.1-06-06). North Dakota does not currently run a statewide ESA or voucher a microschool can bill, so you operate as a private school and families pay privately (or via any federal option once live).

1. Pick your legal structure. Form an LLC or nonprofit so the school is its own entity with a clean bank account.
2. Choose your model. Private school, co-op, or homeschool-serving program — this drives which rules apply.
3. Handle your building. Local zoning, occupancy, and fire-safety rules apply wherever you meet. This is city/county, not state.
4. Carry insurance & run checks. General + professional liability plus abuse/molestation coverage, and background checks for anyone working with children (~$400–$1,200/yr).
5. Set up enrollment & records. Agreements, immunization records, attendance, and an audit-ready place to keep it all.
