The gate: Registering with PDE and appearing on its eligible-school list — then getting an actual Scholarship Organization to fund your families
What the rules actually say

The sequence, in order
1. Form the school entity + EIN. Establish the microschool as an LLC or nonprofit with an EIN and its own bank account. Scholarship Organizations pay tuition to the school, so the school must be a real payee before anything else works.
2. Choose your PA school status and register with PDE (STATE GATE). Pennsylvania offers two routes: a Licensed Private Academic School (licensed by the State Board, which brings teacher-certification requirements), or a Nonpublic Non-Licensed school, which must REGISTER with the Pennsylvania Department of Education. Pick deliberately — the licensed route is materially heavier, and the choice shapes staffing costs permanently.
3. Facility: zoning, occupancy, fire safety. Confirm your location is zoned for a school and passes local fire and occupancy inspection. This is city/township, not state.
4. Complete PA child-abuse and criminal background clearances. Pennsylvania requires clearances for adults working with children. Budget time and fees per adult, and get them started early — they are a common cause of delay rather than difficulty.
5. Get onto the PDE eligible-school list (STATE GATE). Schools submit enrollment forms to PDE, which publishes the list of eligible schools. Families cannot direct EITC or OSTC scholarship money to you until you appear on it.
6. Build relationships with Scholarship Organizations. This is the step founders underestimate. Pennsylvania money is donor-funded: businesses receive tax credits for contributing to Scholarship Organizations, and those SOs decide which students and schools receive awards. Being eligible is not the same as being funded — you need actual relationships with SOs serving your area.
7. Enroll eligible students & receive scholarship tuition. OSTC is restricted to students residing within the boundaries of a low-achieving school, and both programs are means-tested. Confirm which of your families actually qualify before you build a budget around scholarship income.
Where founders actually stall
Pennsylvania founders treat the state paperwork as the hard part. It is not. The money is donor-funded: businesses take a tax credit for contributing to Scholarship Organizations, and those SOs decide who gets awards. You can be perfectly eligible and still receive nothing, because eligibility and funding are two different things here.
What we have not verified
The EITC per-student cap. Our own data records it as unverified, and we did not find it stated on the DCED pages we read. Confirm with the Scholarship Organization you work with rather than relying on any published figure.
