What actually gates ESA money in Virginia

Opening a school in Virginia and getting it funded are two different problems. This page is about the second one: the specific step that decides whether scholarship money can reach you, and what sits in front of it.

What the rules actually say

“No tax credit shall be allowed under this article if the value of the monetary or marketable securities donation made by an individual is less than $500.”

The sequence, in order

1. Form the school entity + EIN. Establish the school as an LLC or nonprofit with an EIN and its own bank account.
2. Confirm your licensing position. Virginia licensing is optional for most private K-12 schools. It is mandatory only for schools serving students with disabilities. Accreditation is available through VCPE, a private body, not the state.
3. Meet health, safety and occupancy requirements. This is the substantive requirement in Virginia. A school becomes eligible largely by being a real school in a compliant building, rather than by passing a state approval process.
4. Run staff background checks. Standard practice for anyone working with children, and expected by insurers regardless of what the scholarship program requires.
5. Connect with VDOE-approved Scholarship Foundations. Foundations pay schools directly. As in Pennsylvania, the money is donor-funded through tax credits, so which foundations operate in your area determines whether any money can reach your families.
6. Enroll qualifying students & receive scholarship tuition. The program is means-tested and small. Confirm current award levels with the foundation before assuming scholarship income covers a meaningful share of tuition.

Where founders actually stall

Virginia is unusual: there is almost nothing to get approved for. Founders go looking for a vendor application that does not exist, and miss the thing that actually decides their income, which is whether a Scholarship Foundation operating in their area has funds for their families.
